SHOULD WE BE SHOCKED? BCSC’S PENSION FUND LISTED IN THE PARADISE PAPERS!

From our friends at BCSC Truthmovement,

SHOULD WE BE SHOCKED? BCSC’S PENSION FUND LISTED IN THE PARADISE PAPERS!

Is the BCSC’s Pension Fund part of a huge tax cheat scandal known as the Paradise Papers?
Should this come to no surprise to anyone?   As we blogged in this post on September 18, 2017, the British Columbia Securities Commission regulates the very same companies that are under the umbrella of the B.C. Investment Management Corporation (“bcIMC”)  – the BC public sector pension fund.  As you can see we questioned how they can ethically keep things above board when they regulate companies that essentially affect their bottom line and pays millions of dollars out to BCSC staff members.  We went on to point out a couple of entities that the BCSC “regulated” after wrongdoing.    But now, can we add the title “ALLEGED TAX CHEAT” to the ongoing saga around the public sector in British Columbia?
According to The Breaker.news website, “British Columbia’s public sector pension investor is listed in the Paradise Papers, the database of offshore investments leaked to a German newspaper and published by the International Consortium of Investigative Journalists.  B.C. Investment Management Corporation, which goes by the brand bcIMC, reported $135.5 billion in assets under management for the year ended March 31, 2017.bcIMC and several related companies are in the database, including a bcIMC company registered in Bermuda at the tax haven’s now famous Appleby law firm.”

Regulators Aid and Abet Fraud Of Elderly Veteran They Are Mandated To Protect

The below letter is from Mr. Alan Blanes in response to the last posting on this blog seen below. This article was written in response to an excellent article by Gordon Hoekstra of the Vancouver Sun which questions why the BCSC has not collected on vast sums of unpaid fines.
Why All The Unpaid Fines Owed To The BCSC?

We have followed the story of Alan and his father Harold Blanes for a few years now as they push for the restoration of justice in the financial sector in North America. Some of these articles can be seen here CBC Go Public Reports On Forged Documents and here among other posts Finance Ministry Aids And Abets Criminal Behavior.

Below is another letter from member of the Council Of Canadians and contact for the Public Banking Institute, Alan Blanes.

                                                          ************************

Thanks very much for this, Christopher...

I have a question before the BC Ombudsperson, re the BCSC knowing that the IIROC Rule 2500 process on verifying new and modified accounts - to ensure that a client is actually in what the sales rep has told them they are in - that this "Rule" has been ignored by the Complaint Departments of two brokerages my dad had the misfortune to deal with. This "Rule" is designed to catch misrepresentation - and if it were practiced, there might be a shred of reliability in the SRO self regulating governance structure. Unfortunately the BCSC has not cared that the management has not bothered to take a stand when the file shows that this verification process was never conducted on my dad's portfolio. The IIROC - the supposed "regulator with the rule" has not cared that the rule was or was not followed - IIROC has even told my dad that he need not bother sending them any evidence - that they would follow the same policy as the previous complaint about another company. This previous example - due to the immaterial, incompetent, and impertinent so-called services of the regulatory system - which was a complete failure, my dad was forced to spend $51,000 in legal bills getting two judgements for breach of contract.

Even when my dad had showed these stooge agencies the two judgements for breach of contract - demonstrating that contrary to their impunity creating indifference, there was in fact merit to what he was claiming - they still had zero interest in correcting the fallout from his experiences.

I have asked Doug MacKay from the BCSC to explain to Stuart Cavers of the BC Ombudsperson's office, why it is that the BSCS has no interest in the matter of the IIROC Rule 2500 being transgressed - and its non-application creating an extremely traumatic fight for a client. Why is it that BCSC thinks that it can just sit back and allow a elderly person in their 90s to have to spend tens of thousands of dollars litigating  - when there is supposed to be a verification procedure. Ignoring it at the Government level is JUST NOT GOOD ENOUGH.

You are more than welcome to be kept in the loop as to what the BCSC and the Ombudsperson reply to this question.

Cordially,

Alan

WHY ALL THE UNPAID FINES OWED TO BCSC?

In a recent statement from BC NDP's finance minster Carole James regarding the massive amount of unpaid fines owed to the BC Securities Commission Ms. James questions why the vast number of unpaid fines have gone uncollected by the BCSC.

These comment can be seen here in a Vancouver Sun article
Hundreds Of Millions In Fines Issued By BC Securities Commission Go Unpaid

Of course we know why these fines have gone unpaid, at least some of them anyway.
Even thought the BCSC has rendered its judgements and filed them with BC Supreme Court it still must take the accused to court to seize their assets.
While the BCSC claims that this is very hard due to the fact that the money is hidden and/or spent we know that this also is not entirely true.

One of the key reasons the BC Securities Commission lets these fines go unpaid is that the BC Securities Commission and many of its staff including former Head of Criminal Enforcement Ms. Teresa Mitchell-Banks operate in a criminal manner with no adherence to their own rule nor the rule of law.

We have demonstrated this in many posts, articles and countless letters to public officials, here is a little on that subject from The Chicago Daily Herald.
Does the Rule of Law not Apply To the Financial Markets? What Happened to Civil Rights and Due Process?

The BC Securities Commission does not protect the markets, it is a weaponized agency whose purpose is give the impression of a tough on crime agency for the public while behind the back of the public it assists a vast criminal network that is looting our province on a grand scale. It does not actually want its actions looked at in a court of law. Even if it is the BC Supreme Court where cases are often fixed by this same vast criminal network, its very risky as the evidence against them is mounting in a wide variety of cases.

Maybe its time to ask why the BCSC owns Securities in the BC Investment Management Corporation, the BCIMC in turn owns hundreds if not thousands of financial securities, many tied in to British Columbia.
 This can be seen here.
BCSC Owns BCIMC Securities, Does BCSC Know Definition of Words Like Conflict Of Interest?

Any real digging into the BC Securities Commission will reveal a criminal network potentially spanning the globe. This is not mere conjecture, there are many case like the cases that have been demonstrated in this post.

The connection between BCIMC and BCSC is organized crime at its best, not only is the BCSC a criminal agency with no regard for the rule of law the BCIMC through its vast holding of companies is very likely worse.
One of the BCIMC's many crimes is to burn down the home of Jack English and Family and steal his $200 Million dollar ocean front property near Tofino BC.
The Full Story on BCIMC and its Crimes Against the English Family

The BC Securities Commission will never address these crimes because it is a major part of them as many have experienced.
The proposed new National Regulator will be no better, its simply designed to hide fraud and perpetuate it.

My name is Christopher Burke and the BCSC has found me guilty of trading without a prospectus yet the BCSC cannot take me to court for the multi million dollar fine it has levied against me not just because I do not have the money and never did, but because how it came to its judgement was through an utterly criminal process. I am not guilty, I was actually a victim. The same can be said for many others who had to deal with the BCSC.
Flawed would be too kind to describe their investigations and indicate this was not a purposeful undertaking when as has been demonstrated on my blog and many others the BCSC is a criminal organization. Christy Clark and Michael DeJong were aware and did nothing but aid and abet. Ms. James I sincerely hope you and Mr. Horgan plan on restoring the rule of law in this province because justice is coming with or without you. We the people will no longer tolerate these crimes against us.

  The BCSC is a Sham.

WWII Veteran Appalled at Lack of Justice and Rule of Law in Canada, Vows to Spend Rest Of Life Ensuring Justice for Others

More from the Desk of Alan Blanes.

We have previously reported on the story of Alan an his father Harold Blanes many times as they continue to push for the restoration of the rule of law in the economic sector.
CBC's Go Public also featured the Blanes and their quest for justice this summer.

Finance Ministry Guilty of Obstruction of Justice

Below is further dialogue from Mr. Blanes on the subject of financial fraud in Canada across all spectrums that is perpetuated and aided by the very regulators that are supposed to protect us.

                                                     ***********************

"Dear supporters of the Valid Governance Principles of Original Society Culture - as compared to the Immaterial, Incompetent and Irrelevant Nonsense that is Plaguing Securities Regulation in BC:

Earlier today, I answered a question from a member of the Ontario Securities Commission Advisory Council on the deliberate dehumanization and bad faith that has been imposed on my father, Harold Blanes, by the government standing by and defending regulatory capture that uses fraud and issuance of counterfeit contract documents in order to trap senior citizens who are seeking Guaranteed Saving Certificates.

The fact that the government of BC allows such bad faith, may forfeit it of having governance over this field. It is time that there is real restoration of the pre-colonial values that are needed if we are to have credible investment regulation.

Yes Ken - Dad signed a form marked "Great West Life" on February 1, 2007 that stated that it would provide an income no later than the end of the first calendar year [which would be 2008]. My parents at the time assumed that this was just an insurance scheme to guarantee the proposed GICs. After this - the next day, my mother Gladys Blanes, was admitted to hospital and lived until Feb 28, 2007. Instead, this non-performing false offer of contract, that was signed, did not "provide an income", it provided a $25,000 drop during the last quarter of 2008. This means nothing to the fraud enabling and facilitating regulative sham agencies. It never registers with these enablers to ask a simple question: "why were all the forms that were given to Harold and Gladys Blanes riddled with misleading hints of "guarantees" when they were instead covertly serving up mutual funds?" Do not regulators have any clue of the fact that this constitutes deceptive dealing? If they do not grasp this, why do they not grasp it?
How anyone could believe that this nonsense documents that dad was "asking for segregated funds and just not remembering" - defies credulity. I expect that the government of BC will clue in that it has to challenge this dehumanizing bilge, or its authority to regulate investment could be threatened has having no legitimacy. Courts have been providing many decisions that confirm Indigenous title in BC - and when a level of government proves that it is incompetent to oversee investment regulation, then the other governance structure must be investigated as to whether it would govern investment according to Original Society rules. No elder abuse...No violation of Mother Earth...Only investment that leaves us better off in 7 generations --- those values may have to replace the colonial rip off model.
I will be speaking to sincere Green Party activists who are familiar with the writings of Prof. Sylvia McAdam (Saysewahum) about the possibility of banning colonial investment customs that include elder abuse and deception in their business model. I have completely had it with non-regulation of investment in this province, and I know that on this Remembrance Day, my dad is just not willing to allow his experience of impunity for bad faith dealing - to mean that his client experience will be used to further destroy the protection of good faith dealing... something that everyone must demand.
Here is a link to Professor McAdam's book: http://www.purichpublishing.co m/?module=swm_ecommerce&page= product_detail&categoryID=4& productID=102
I will keep you apprised of anything that may come from this.

Good afternoon to Doug MacKay, BC Securities Commission and Stuart Cavers, BC Ombudsperson:
Just a reminder Doug, from our conversation last week, when you stated that you would contact the Complaint Department of BCSC and find out when precisely the Harold Blanes' complaint concerning his experience with Investors Group, was officially acknowledged as a complaint with the BCSC. Since then, we are in receipt of no answer.  When you are able to provide this information, please send a copy to "alanblanesarchive@gmail.com".
Mr. Stuart Cavers has requested that all information pertaining to genuine complaint origination with the BC Government be given to him by today's date.
I would appreciate your co-operation in getting the record clearly understood at all levels within the Government of BC that, for years, Harold Blanes has stated that he contracted in good faith for GICs to be held in trust by Investors Group in 2007. Instead of that company  following through on what was stated in the March 15, 2007 signed agreement, they told Harold Blanes two years later, in 2009 "You are not a client of Investors Group...You are a client of Great West Life". The Investors Group company claimed that Harold Blanes actually asked for segregated funds but has forgotten about that due to "failing memory" [sic].
Despite sympathy from BC Government departments, Harold Blanes has seen nothing but the enabling of fraud, by the unwillingness of each official to acknowledge simple factual records.
The letter from Sheila Vickery of the Complaint Department of Investors Group from August 17, 2009 stated that there is no evidence that Harold Blanes ever asked for GICs. The letter of Tom MacKichan from Jan 7, 2010 claims that Harold Blanes chose against GICs due to them not paying enough. This is not supported by the FACTUAL RECORD, as it clearly demonstrates that Harold Blanes did in fact ask for GICs from the record signed March 15, 2007.
The question arises: Why have BC Government Ministries chosen to ignore the fact that an elderly senior can demonstrate that he did in fact ask for GICs and the protestations of this from Investors Group are disproven by the paper trail? The question is "why": ... Does not the Government of BC have a commitment to protect the elderly from predatory deceptive dealing??? Are the retirement years of an old WWII veteran that expendable - that he can be put through years of unending hell, when a simple questioning to Investors Group on the matter of whether Harold Blanes, or did Harold Blanes not, sign a request for GICs on or about March 15, 2007, and if so, what would have nullified this part of the record???
4
Harold Blanes is one of about 60,000 WWII veterans who is still alive out of over a million who acted to protect Canada as a representative democracy, at Juno Beach in 1944. He did his share to enable us having an accountable form of governance. The letters from Heather Wood of the Ministry of Finance demonstrate no acknowledgement of a rationale of any kind, for the inexcusable abuse that is being suffered by Harold Blanes. He acted in good faith at all times - yet blatant lies and treachery, are being defended by the BC Government against this citizen. Simply repeating that the regulators believe he never requested GICs is just not good enough, when the record shows the opposite.
Harold Blanes would like to know - if BCSC is aware that the IIROC Rule 2500 is supposed to be carried out on new and modified accounts - and the portfolio file shows clearly that this process was never conducted - why does the BCSC not regard this as indicative that IIROC is not capable of any form of "enforcement", if it fails to treat its own rules seriously?
Harold Blanes is not going to sit back and expect to have to get another $51,000 bill for legal services over something like this, that he was forced to spend over the Canaccord case. He wants to spend his remaining time on Earth ensuring that his experience does not become a benchmark for corrupt investment management - he, as a responsible citizen, does not want future people to be treated as expendable "marks" to be sacrificed for maximization of profits within a system of organized impunity for blatant, overt swindling.

Please give Mr. Cavers the record of when Harold Blanes' originating complaint was received, and also if you would provide a reason for failing him so completely and needlessly, and also please try to justify the fatal level of stress that this derelict policy imposes on those who are trying to uphold responsible and honest business practices. I - as an advocate for Harold Blanes, have been diagnosed with a very hormone-dependent form of cancer. I can only surmise that the reason for this is that my system has had to generate unusual amounts of cortisol - as a reaction to the constant frustration suffered by the dehumanization and neglect that passes for governance of the investment industry.
I do not give up hope that eventually the impulse to stick up for simple accountability will emerge within a social democratic form of government.
Best regards,"

Alan Blanes, for:
Harold C. Blanes

From The Desk of Alan Blanes,

Alan who is the lead Canadian contact for the Public Banking Institute and a member of the Council of Canadians continues to question the absence of justice and the rule of law in our financial regulatory systems. See below.

                                                   **************************

To the attention of Heather Wood:
cc Hon. Carole James, Hon. David Eby, Hon Mike Farnworth, and MLAs

Thank you for the letter you sent today at 7:26 P.M.

Heather, we live in a democracy. This is presumed to be a political system where accountable reasons are provided for politically decided policy. Your letter addresses none of the issues associated with an investment company in BC claiming to have GICs which it is pledging to hold in trust for Harold C. Blanes, in a document signed by the client and the Investors Group salesperson and the Regional Director of Investors Group - Mr. Paul Demay - occurring on or about March 15, 2007. Issues surrounding the fact that the company was delinquent with the Office of the Superintendent of Financial Institutions [OSFI] and therefore was not authorized to offer the holding of GICs for clients, made this offer unlawful and undeliverable. This status of Investors Group as not being current in its corporate returns for its GIC Division "Investors Group Trust Company Limited" remained until February of 2014, when it re-registered with the OSFI. Harold Blanes utterly rejects all assertions that this signing of this undertaking had anything other than an intent to deceive.  The contract document also involved the providing of the drivers' licenses of the client and the consultant. It was not just a fanciful 'possibility of what kinds of securities may at some point in time be offered'. There is no reasonable way that such fluff could be read into the March 15, 2007 agreement. It says the Investors Group Trust Company Limited would hold GICs in trust for Harold Blanes. No "maybes" and "possible future range of various products". It is incredible that anyone is being asked to believe such a canard of an interpretation. The Ministry of Finance should not be so naive. This document signed by Harold Blanes on or about March 15, 2007 should be seen squarely for what it was: a creation of fiction with one purpose: to mislead the client into thinking he was being signed up for GICs. How could you try to excuse such a dishonest ploy? How could you rationalize someone who at the time of his being 86 years of age, would have to forfeit the enjoyment of retirement years having to fight and put up legal expenses over something this illegitimate? There are egregious aspects to what this company did. For one thing - while Harold Blanes was in a coma at the Kelowna General Hospital in February/March 2007, the company - without knowledge or consent racheted up his risk tolerance to "high". No regulator to this date ever questioned any of these outrageous acts.

Harold Blanes - a 97 year old World War Two Veteran - who put his life on the line in June of 1944 on Juno Beach, Normandy, for Canada to have honest and accountable governance - is becoming profoundly worried that the impunity that is being provided to Investors Group in its fraudulent misrepresentations, is setting an intolerable precedent.  This company is being allowed to avoid having to explain why it provided misleading documents for the signature of the client - when it had no intention or capacity to "hold GICs in trust". Harold Blanes rejects the notion that an investment company may freely engage in the  hijacking of $414,000 of his savings - which he had been led to believe would be providing him with 4% interest for a 2 year GIC. Later findings indicate that there was more that one check mark on the "Time Horizon" line of this contract, and the box that would have been required for a seven year holding - was left blank. No "compliance officer" had scrutinized this record - which would have clearly required explanation - and a verification determined of what exactly what were the intentions of the client. None of this happened - and there is ZERO evidence that the IIROC Rule 2500 was ever carried out - that requires another staff person to check with the client when a new account is opened - to determine if the client is holding what they are told they are holding. IF THIS RULE WERE TREATED SERIOUSLY BY REGULATORS - ALL OF HAROLD BLANES' ISSUES WOULD HAVE BEEN CAUGHT, AND THIS WOULD HAVE BEEN MANAGED APPROPRIATELY WHEN IT WAS ORIGINATING.

Instead, the IIROC paid no attention that its rule was ignored. The BC Securities Commission had not paid any attention to the fact that this procedure was absent in Harold Blanes' file. Instead he had been subjected to a decade of inexcusable torment and trauma. He has been left to have to experience an other-worldly level of abandonment and despair. Clearly, the regulation of the sale of GICs under false pretences is not treated as a serious matter in BC, and therefore it is going to be a priority of Harold Blanes in his latter years, to encourage that an independent verification process be organized by groups that have actually worked in previous years to protect our democratic institutions as honest, good-faith providers of services. The Royal Canadian Legion is a possible organization that may be able to invite interested members to begin to research what would be involved in achieving a public role for account verification.

This is a realistic way to engage the clients of investment companies in the process of making sure that there is authentic checking with clients to determine their holdings.

A British report on engaging the public in securities regulation:

Harold Blanes is not making up his complaint, and I was a witness to much of the representations that were made to him by this company. It has become an example of deliberate corrupt practice, that Harold Blanes has been told to use the Insurance Council of BC as the venue for his grievance. This would only have been appropriate - if and only if - he had chosen to contract for risk based insurance products. The regulatory apparatus has been acting disingenuously in expecting him to go to the wrong agency - and then  to experience being told that his complaint has no merit. Noam Chomsky has written about mangling the concerns of complainants - and then dismissing the grievances as having no relevance. The Government of BC should be above such a cynical elder abuse practice.

Last year, Harold Blanes met with Brian Dillon of the Ministry of Finance Policy office. Mr. Dillon stated that there was going to be a review of the financial institutions that come under the Ministry of Finance of BC, and I would like to find out if this review process had commenced. The links to the backgrounders provided by Brian Dillon:

Mr. Alan Blanes:

Thank you for your phone call.  As discussed, I have booked a boardroom for us to meet on Monday August 29 at 1:30 pm.  The building is secured and there is no reception, so we will need to meet in the Lobby of my building, at 617 Government Street.  Please see the detailed note on meeting location below.

If you need to adjust the time, please let me know as my schedule so far is very flexible.

As mentioned, the government has commenced a review of its financial institutions legislation (including the province’s regulatory framework for insurance companies, insurance agents and trust companies).  Here are links to the discussion paper released last year and the paper summarizing the responses received during the consultation period:

I should note that this review does not encompass any matters relating to the administration of justice, such as court fees and costs.  This is the responsibility of the Ministry of Justice.

I am looking forward to meeting you and your father on Monday.

BEYOND BANKSTERS - The Joyce Nelson Tour

More from the desk of Alan Blanes,

I am greatly looking forward to reading BEYOND BANKSTERS. It is remarkably good that Council of Canadians chapters are getting enthusiastically engaged in the Beyond Banksters Tour.

A very significant aspect of the lawlessness that has arisen from the non-regulated SRO culture [self regulated organization], is its providing an impunity system for fraud and related violations of Sections 361-363 and 380 of the Criminal Code of Canada, that in a sane world, would be governing the sales of securities - stopping their sales under false pretenses.

I have spent a decade looking at the structural barriers to having the criminal code recognized and enforced in Canada on investment sales. There is a demonstrable unwillingness on the part of the mediative resources such as OBSI, Ombudsman on Banking Services and Investment, to assert any acknowledgement of the foundations of good faith.  OBSI will not acknowledge evidence of  dishonest dealing - but is only interested, in the case I have witnessed, is in getting the swindled client to sell the fraudulently dumped product. OBSI has shown that it is not willing to look at the extortion-type gag orders that the investment broker is willing to impose on the victim, in exchange for returning their funds. It claims that it is only looking at the matter of whether losses have been experienced by the client - but appears to not understand that sticking a client in a hidden 7 year lock in and putting a client's savings at risk - when the client has contracted for guaranteed savings - is against the law, and the law will only be enforced if those who see the evidence of violations are willing to document the malfeasance and take a stand against it with law enforcement. The whole regulatory culture in BC has a policy instead of parroting: "We are not allowed to look at the Criminal Code".

In the past decade, I have saved hundreds of e-mail items of correspondence with the organization that are supposed to be guarding good faith practices in the marketing of securities; I have seen and saved countless replies that show clearly that the practices of deceptive dealing are now being protected by the very organizations that are supposed to be protecting the public. I have never found any interest in making sure that the Rule 2500 of the Investment Industry Regulatory Organization of Canada - that requires confirmation of new accounts by having another staff person within an investment brokerage, check with the client to ensure that the client is actually placed in the securities that they have chosen to contract for. This missing factor is responsible for many elderly people being subjected to enormous legal expenses, and years of unnecessary torment.

CBC GO PUBLIC has uncovered a lot of facts that the Canadian public has up until now, not been made aware of. My dad's case is central to some of the coverage cited here:

The Green Party of BC is holding its AGM in Sidney on August 18 and 19. I am volunteering at that conference, and I am interested in finding anyone who shares my concern for getting rule of law restored in securities and investment in Canada. BC has been among the most lawless jurisdictions over the past several years. If the Green Party and the NDP could begin a dialogue on this topic - and create a tag team approach to getting the public on side, by reinforcing each other with coherent proposals for building an honest investment oversight system, this problem will be contained.

BC Securities Commission Ordered To Pay Legal Costs In BC Court Of Appeals Loss

Further on the case of Poonian v. the BCSC, BCSC is ordered to pay legal costs in BC Court of Appeals case it recently lost. This is the same case where the BCSC withheld hundreds of pieces of evidence so it could 'make' its case against Mr. Poonian. We have previously reported on this here among other posts. Breaking News in the Case of Poonian v. BC Securities Commission

The BC Securities Commission will not Appeal the ruling by the BC Court of Appeals to Canadian Supreme Court. Mr. Poonian will no longer have to pay any fines or disgorgement fees to the BCSC as a result of this ruling along with BCSC covering his legal costs. See court documents below, to obtain a copy of this ruling one can email bk1092003@yahoo.ca and request documents pertaining to this case should they not be made available online by the various government agencies involved.
